Re: Boris off to court for lies during Brexit Campaign
Well should the situation you described arise, we'll have to cross that bridge when we come to it (although, of course, there are other remedies in law available to the sitting MP).
The rules are applying to the conduct of the 3 candidates in your example, not to the contest they are involved it. As a sitting MP, he or she also has to understand that they are in Public Office - I don't see a problem with that at all (in any situation).
Trying to judge each person by the same rules is just silly - your legal experience will tell you that the punishments for dishonesty when the individual is in a position of trust are more stringent than those for "ordinary" members of the public. Police Officers who lie or fabricate evidence are held to higher standards than members of the public in many instances and can be prosecuted for misconduct in Public Office.
Do you not think there should be such an offence as Misconduct in Public Office?

I am pointing out that a sitting MP will be unable to fairly contest a by election as he has different restrictions to his rivals. A fair playing field should apply to all.

Re: Boris off to court for lies during Brexit Campaign
Given that we're talking about lying here, I hardly think he'll be "unable to fairly contest" the by election! I'll grant you that he won't be able to match them lie for lie, but that's quite a low bar.

Point of order, Spen - you can't have a sitting MP and a by-election at the same time. A by-election is caused by the sitting MP ceasing to be the MP.
Everybody contesting an election is a Prospective Parliamentary Candidate, whether they were the sitting MP or not. At a general election all 650 MPs cease to be MPs and become PPCs along with all the other candidates.

Re: Boris off to court for lies during Brexit Campaign
The sitting mp will also be contesting the election full time as it’s his job, whereas the rivals are doing it in their spare time. I’m sure they’ll cope with not being able to lie as much as those rivals.spen666 wrote: ↑Mon Jun 03, 2019 3:45 pmI am not arguing against the misconduct offence.StillSpike wrote: ↑Mon Jun 03, 2019 3:20 pm Well should the situation you described arise, we'll have to cross that bridge when we come to it (although, of course, there are other remedies in law available to the sitting MP).

Correct, unless MP is a Cabinet Minister when he or she would remain in role until after election. So same scenario as before but read cabinet minister for mpA Pedant wrote: ↑Mon Jun 03, 2019 9:00 pmPoint of order, Spen - you can't have a sitting MP and a by-election at the same time. Well then ,maybe he should have been tried in Scotland instead . That's a lesson for any future court battles . I wonder if it was possible he was actually telling the truth and not lying .Max B Gold wrote: ↑Fri Jun 07, 2019 1:27 pmGood old English justice sides with the Great Big Liar.spen666 wrote: ↑Fri Jun 07, 2019 1:21 pm Boris not going to court now after going to court today!

Re: Boris off to court for lies during Brexit Campaign
So if it is a 'political' campaign you are allowed to lie your socks off to get people to vote your way, but it is illegal if you do it when in office. What an absurd way to run a democracy.

Agreed because that was not what the Court considered.
