Transfer Rumours - Winter Signings

Post by Thor »

So who do you think we need to sign urgently? I've looked at all the rumours sites and we are not linked with anyone. If you hear something please post in here.

I've given 3 votes to each person as we need more than 1 person in urgently in my opinion.

More chance of signing Derek Hatton or Ricky Tomlinson

Keeper and centre mid equal high priorities for me.
Good quality forward a slightly lower priority.

I guess we dont have a lot of money available (Fletcher pay-off, FA-cup exit) so I think we should use what we got on a central midfielder.

Lets hope you are right. I would still like to spend it all on a midfielder!

I agree. A central midfielder has to be our top priority

Given that you don't see players or managers giving one month's notice and leaving for nothing I'd think football contracts are different to normal contracts in that respect.

I don't think a player or manager could terminate a deal themselves without becoming liable for the rest of their contract.

A club could terminate a deal at any time, however it'd be stipulated in the deal what the terms were. I can't imagine a situation where a manager would sign something which allowed him to get the bullet after one month free of charge or for little money. If that was widespread you'd see lots of Fletcher-type situations up and down the country, but it is very rare.

The club's protection against Fletcher being crap was the relatively short 1.5 year deal they offered, but I don't think they envisaged it going so bad so quickly.

I do believe there will be cash to spend if we are looking in a bad state. At the end of the day it seems that the club will be paying for it anyway in the form of increased loans.

It would not be a suprise if CF received virtually nothing

He was dismissed within one month - there must of been a termination clause that they activated - I can't see football contracts going much different to any employment contract with the duration not honoured if there was that clause

Well, there is one huge difference that stands out.

Most employment contracts are contracts "at will"...ie either party can give the notice period and leave.

Footballers and managers are on fixed term contracts, i.e. they can't just hand in notice and leave. They are contracted to the club and vice versa for a fixed term This enables clubs to demand compensation (or transfer fees) if person wants to leave.

This is a fundamental difference between contracts of players or managers and most employment contracts

Have you actually read a footballers contact carefully to review the difference if any

I know the difference between a fixed term contract and a contract "at will"

Are you really seriously suggesting footballers contracts are not fixed term ones? Why do you think they announce X footballer has signed a 2 year contract or whatever length if it is not a fixed term contract? If it was not a fixed term contract, then there would be no basis for transfer fees. Player X could simply say to say Orient i'm going to Man U, here is my 2/4 weeks notice as case may be

If their is any one on this forum that actually knows the standard league managers contract that is used by their organisation - and knows how it differs from the private contract between the parties here

Then we would all know if there was a termination clause that was enforced

You seem to be confusing a termination clause with a fixed term contract or a contract "at will"

A fixed term contract or contract "at will" are specific types of contract.

A termination clause is a term which can be inserted into a contract.

I am not sure what you are trying to achieve by trying to conflate the 2 distinct things.

I have no idea of the specific anyone else's contract. I specifically have said nothing about a termination clause being in Fletcher's. Indeed, I highlighted and underlined your comment
I can't see football contracts going much different to any employment contract
to make it clear what I was responding to.

don't try and drag me into an arguments about something I have not commented upon.

I you are so keen to know whether there is a termination clause, then ask either Fletcher or orient as they are the only people who know.

Let's cut the crap on this as I know you are a person that loves to post on here in a way that turns you on

Yes a fixed term contract does not automatically mean you get a pay out based on the total value of the contract if it ends before the end date on the contract.

You are making a generic assumption based on your understanding of employment law.

Once again, you are arguing about things I have not said.

I have not made any mention of payouts people may or may not be entitled to. I have however made it clear I am not privy to any terms of his or anyone else's contract, so am not commenting on the terms of any contract

I simply said that one difference between football contracts and others contracts is that football ones are fixed term contracts rather than the "at will" contracts most people are employed upon.

I have not gone beyond that, so no idea why you are trying to drag me into an argument.
