Not in a Union. FFS, why not? That’s exactly what unions are for. At times like this they’re worth their weight in gold.
They may have been in the past. Union's are pretty much hopeless nowadays especially in cases like this. The best he can hope for which isn't much is the statutory redundancy of a weeks money for every year he's been there.
Hope the rumour isn't true though.
Just had a long chat over coffee with Pete , he says certain members of staff ( including Management ) are now ignoring him and its not a very nice atmosphere , also a new young guy started on friday who is being trained up to work in both the shop and warehouse , although Pete has worked there nearly 6 years the only contract he has had is dated 1st Janurary 2018 !! the contract says he hasto give 4 weeks notice but the company only have to give him reasonable notice ?? , in the case of misconduct he can be dissmissed without notice , my brother reckons the guy is going to let him go at the end of the month and make up some crap about misconduct to avoid paying him redundancy , ive told him to make sure he behaves and if the worst happens make sure everything is in writing so he can do something about it .

Totally disagree, it may I agree depend on which particular Union you are a member of.
I was a full time official for over 25 years and dealt with more discipline cases than I can possibly remember and only lost a handful out the door and won many on appeal too.
If you have got a job, get a Union .

I feel sorry for your brother. what a terrible way to treat a long term member of staff. This has unfair dismissal written all over it. I agree he should try and get things down in writing and then take them to a tribunal
Ron, the fact that he only got a contract is kind of irrelevant. He's been employed there for many years and any severance will be judged on that basis. If the try dismissing on a trumped up misconduct basis, your brother will probably have them over a barrel. if they try and get this lad to do his job, your brother will again have them over a barrel.
I'm not sure if I'd want to work in such a business, but I have no understanding of your brother's prospects. In such a situation, I'd make sure the company's offer of redundancy was full and fair - and move on. If they tried anything underhand then I'd make them pay for that.

Reasonable notice?
That is a load of b—————s.
They will have to give one weeks notice for every compete year up to a maximum of twelve.
The only way out of this would be gross misconduct.
This would have to be a serious act ie theft or fighting.
I would suggest your brother joins a union and talk to them about he’s concerns, unfortunately there maybe a 12 week qualifying period before they will offer any representation.

Not a lot of good when they offer no representation to a member when they are facing redundancy. That was my experience, even the higher ups at Unite didn’t see anything wrong in this.

Not a good idea to tell them to shove it.
Hang around for the payoff, he will get about 3-5k tax free and 5 weeks notice.
He will also be able to sign on the dole and get a minimum of £73.10 per week for 6 months and also get class 1 NI paid.
He will lose all of this by walking out.
Not sure if it’s already been said but if it is a redundancy situation he will be due the following.
You’ll normally be entitled to statutory redundancy pay if you’re an employee and you’ve been working for your current employer for 2 years or more.
You’ll get:
half a week’s pay for each full year you were under 22
one week’s pay for each full year you were 22 or older, but under 41
one and half week’s pay for each full year you were 41 or older
Length of service is capped at 20 years.
There is quite a lot of information on gov websites, recently got made redundant so looked into it. There is loopholes they can try to squeeze through to not pay redundancy, ie if they offer alternative employment where the loss of earnings isn’t greater than a certain percentage of current earnings, think it’s 25% but don’t quote me. I had to fight for my redundancy because they tried this on me but in the end got granted it as the alternative employment although not a massive loss of earnings was at a lower (non managerial) grade.
